Terms of Service

1. Eligibility

You must be at least 18 years old to use PassItOwn. By using the Service you represent that you are at least 18, that you have the legal authority to enter into these Terms, and that the information you provide is accurate.

2. Description of the Service

PassItOwn is a technology platform that allows users to gift or pass along items within trusted groups and circles. PassItOwn does not own, store, ship, inspect, negotiate, deliver, or participate in the transfer of items. PassItOwn is not a party to exchanges between users.

3. User Accounts

Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. Accounts may be suspended or terminated for violations of these Terms.

4. Acceptable Use

Users may not post or distribute:

  • Firearms, weapons, explosives, or ammunition
  • Illegal drugs or prescription medications
  • Alcohol or tobacco products
  • Hazardous materials
  • Recalled or unsafe products
  • Stolen or counterfeit goods

    • Users may not harass, threaten, impersonate, defraud, or spam other users.

    5. User Content

    "Content" means the listings, item descriptions, and item photos you post to the Service. Content does not include your private messages or the private account information described in Section 5.3.

    5.1 License to PassItOwn

    You retain ownership of your Content. By posting Content, you grant PassItOwn a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for example, crop, resize, reformat, blur, or translate), adapt, publish, publicly display, and distribute that Content, in any media now known or later developed, for the purposes of operating, improving, and promoting the Service, including in marketing, advertising, social media, app store listings, and press materials. PassItOwn may sublicense these rights only to service providers and partners acting on its behalf for these purposes.

    5.2 Duration

    This license lasts for as long as your Content remains on the Service. If you delete Content or your account, PassItOwn will stop making new uses of that Content within a reasonable time, but may continue to use promotional materials that were created or published before the deletion, and may retain copies as described in the Privacy Policy.

    5.3 What We Will Not Use for Marketing

    PassItOwn will not use any of the following in marketing or advertising: your private messages; your email address, phone number, or date of birth; your location data; your friend list, friend nicknames, group names, or group memberships; or any other information marked as private in the Privacy Policy. PassItOwn will not use your name, profile photo, or likeness, or any photo in which a person can be identified, in marketing or advertising without your separate, explicit permission. When we feature Content in marketing, we will not attribute it to you by name unless you have given that permission.

    5.4 Your Promises About Content

    You represent that you own your Content or have all rights needed to post it and to grant the license above, and that any person who can be identified in your Content has agreed to its posting. You may not post photos or text that you copied from others without permission.

    5.5 Feedback

    If you send PassItOwn suggestions, ideas, or feedback, PassItOwn may use them for any purpose without obligation or compensation to you.

    6. Reporting and Moderation

    Users may report content or accounts that violate these Terms. PassItOwn may remove content, restrict accounts, or report illegal activity to authorities at its discretion.

    7. Items and Transfers

    All items are offered "AS-IS" and "AS AVAILABLE." PassItOwn does not verify ownership of items or guarantee their condition, legality, or safety. Users are responsible for ensuring they have the legal right to transfer any item listed.

    8. Safety Disclaimer

    Users interact at their own risk. PassItOwn does not conduct background checks and does not guarantee the identity or behavior of any user.

    9. Intellectual Property

    All platform software and branding are the property of PassItOwn. Users may not copy, reverse engineer, or distribute the platform without permission.

    10. Intellectual Property Complaints

    If you believe content infringes intellectual property rights, contact support with documentation of ownership.

    11. Third-Party Services

    PassItOwn may use third-party services including hosting providers, analytics services, and cloud infrastructure providers such as Firebase by Google.

    12. Limitation of Liability

    To the maximum extent permitted by applicable law, PassItOwn shall not be liable for indirect, incidental, special, or consequential damages — including loss of data, property damage, or personal injury — arising from your use of the Service or your interactions with other users. Nothing in this section limits PassItOwn's liability for its own gross negligence, willful misconduct, or fraud, or for any liability that cannot be excluded or limited under applicable law.

    13. Indemnification

    Users agree to indemnify PassItOwn against claims arising from their use of the Service, posted content, or interactions with other users.

    14. Arbitration and Dispute Resolution

    Disputes shall be resolved through binding individual arbitration where permitted by law. Users waive the right to participate in class actions for claims subject to arbitration. This section does not apply to claims of sexual assault or sexual harassment, which may be brought in court as provided under applicable federal law. Users may opt out of this arbitration agreement by sending written notice to support@passitown.app within 30 days of first agreeing to these Terms — for existing users, within 30 days of the "Last Updated" date above.

    15. Governing Law

    These Terms are governed by the laws of the State of Utah. Any disputes not subject to arbitration will be resolved in courts located in Utah County, Utah.

    16. Changes to Terms

    PassItOwn may update these Terms periodically. For material changes, we will notify you in the app and ask you to accept the updated Terms before you continue using the Service. Changes to how we may use your Content apply only to Content posted after you accept the updated Terms, unless you agree otherwise. For other changes, continued use of the Service after the "Last Updated" date constitutes acceptance.
